　　针对卖家用“呼死你”软件恶意骚扰买家的行为，北京问天律师事务所主任合伙人张远忠昨日认为，卖家的行为违反了《治安管理条例》，买家可以报警，或者进行民事诉讼进行索赔。
　　中国人民大学法学院李元起教授表示，卖家的此种行为已经构成了对买家个人自由、通信自由的骚扰，是违法行为。他认为，如果买家故意拒绝收货，卖家可以通过淘宝客服或者协商的途径进行沟通，或者通过法院等其他机关进行解决。如果买家不是恶意拒绝收货,[link widoczny dla zalogowanych]，卖家更不应该恶意骚扰。
　　不过，北京汉卓律师事务所上海分所张向锋律师表示，由于来电采用未知号码具有不确定性，调查取证十分困难，而且，骚扰程度比较有限，属于影响轻微，按照法律最高可处以15天拘留和警告处罚，难以对违法行为形成震慑。

　　李元起教授认为，如果《软件开发法》没有禁止开发此款软件，此款软件也有正当的用途，那么，不应该追究软件开发商。如果，此款软件本身就是为了恶意骚扰而开发的,[link widoczny dla zalogowanych]，那么，也应该追究软件开发商的责任。
